Tell a creditor you are in breathing space (sole name)

Use this letter to tell a creditor that you are in a breathing space moratorium.

You can choose to send a letter in your own name or in joint names. You may have a debt in joint names, or want to write to your creditors together because you have worked out a joint budget.

  • Today’s date will be added automatically.
  • Sign each letter and enclose a copy of your budget if needed

Letter in joint names

You need to include the organisation name.

Reg. 11 (1) says that “During a moratorium period neither a creditor nor the creditor’s agent must contact a debtor in relation to the enforcement of a moratorium debt, including to demand payment or as a precursor to starting any legal proceedings against the debtor in connection with the moratorium debt”.
Reg.7 says that a creditor must not:
(a) take a step to collect a moratorium debt from a debtor; or
(l) contact a debtor for the purpose of enforcement of a moratorium debt.
