Use this letter to tell a creditor that you are in a breathing space moratorium.

You can choose to send a letter in your own name or in joint names. You may have a debt in joint names, or want to write to your creditors together because you have worked out a joint budget.

I ask you not to contact me further because I have entered a breathing space moratorium through National Debtline). You are required to follow the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020.

Reg. 11 (1) says that “During a moratorium period neither a creditor nor the creditor’s agent must contact a debtor in relation to the enforcement of a moratorium debt, including to demand payment or as a precursor to starting any legal proceedings against the debtor in connection with the moratorium debt”.

Reg.7 says that a creditor must not:

(a) take a step to collect a moratorium debt from a debtor; or

(l) contact a debtor for the purpose of enforcement of a moratorium debt.
