Use this letter to tell a bailiff that our client is in a breathing space moratorium.

Letter in joint names

You can choose to send a letter in your own name or in joint names. You may have a debt in joint names, or want to write to your creditors together because you have worked out a joint budget.

Change to joint version
You need to include the organisation name.

Our client has contacted us regarding the above account.
We ask you not to visit or contact our client because they have entered a breathing space moratorium through National Debtline. You are required to follow the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020.
Reg. 11 (1) says that “During a moratorium period neither a creditor nor the creditor’s agent must contact a debtor in relation to the enforcement of a moratorium debt”.
Reg. 12 (4) says that “During a moratorium period, an enforcement agent appointed in relation to a moratorium debt who is notified of a moratorium or is otherwise aware that a moratorium is in place in relation to a debtor must not in relation to any moratorium debt—
(a)give notice to the debtor under paragraph 7 of Schedule 12 to the Tribunals, Courts and Enforcement Act 2007,
(b)visit the debtor’s place of residence or business for the purpose of taking control of goods,
(c)take control of goods,
(d)sell goods belonging to the debtor unless the enforcement agent took possession of the goods prior to the start of the moratorium, or
(e)require the debtor to pay fees, penalties or charges that accrue during a moratorium period relating to the storage of goods seized before the start of the moratorium.
Please stop all collection activity on this account until the breathing space moratorium is complete. If you continue to break breathing space rules, this will be reported to the Insolvency Service.
Please send confirmation to our client that breathing space protections will be applied.
